Report: AG Kathleen Kane to soon be criminally charged

Quote:HARRISBURG —

Pennsylvania State Attorney General Kathleen Kane is expected to be charged criminally as soon as Thursday in connection with an investigation that began last year with a statewide grand jury, sources told the Channel 11’s News partners at TribLIVE.

"At this point I can't confirm anything," New York City lawyer Gerald Shargel, who has represented Kane since she testified before the grand jury in November, told TribLIVE. "We continue to maintain she is innocent of any wrongdoing and she has no plans to resign her office."

Of COURSE she's not resigning - she's a DEMOCRAP!!! She'll be IN prison, asking if she can still hold office from her jail cell!!! Rolleyes

The Associated Press

HARRISBURG, Pa. —

Portraying herself as a victim (aren't ALL DEMOCRAPS? Angel ), Pennsylvania's attorney general said Wednesday that criminal charges threatening to end her career were part of a "grand plan" to conceal pornographic and racially insensitive emails circulated among judges and state prosecutors.

"I am innocent of any wrongdoing," Kathleen Kane said in her first public comments on the case. "I neither conspired with anyone nor did I ask or direct anyone to do anything improper or unlawful."

She didn't address the specific allegations leveled against her last week, saying she couldn't on the advice of counsel. But she challenged a state judge to make public the "filthy email chain" that led to last year's porn scandal, promising to call a second news conference and answer every question if the judge met her terms.

A suburban Philadelphia district attorney charged Kane with leaking grand jury information to a newspaper reporter in an attempt to embarrass a former prosecutor she believed made her look bad, and then lying about her actions under oath.

Kane, 49, hasn't entered a plea. She faces up to seven years in prison on the most serious charge, perjury.

Reading a prepared statement, the attorney general described the leak investigation and criminal charges as a "stealth political weapon" to oust her from office and block her from challenging a judge's order. She said the order bars the release of a collection of undisclosed pornographic, racially and religiously offensive emails sent on state computers.

"We heard even before the charges were announced against me that this grand plan was in the works," she said.

She said the campaign to discredit her began immediately after her office uncovered pornographic and explicit videos, images and jokes in hundreds of emails while examining how state prosecutors under her predecessors handled the child sex abuse case against former Penn State assistant football coach Jerry Sandusky...

"Some involved in this filthy email chain have tried desperately to ensure that these emails, and more importantly their attachment to it, never see the light of day," Kane said.

Kane said the email scandal, which surfaced last summer, resulted in six firings, 23 reprimands and two high-profile resignations, including state Supreme Court judge.

She said Wednesday that more people are involved than previously disclosed and called on the judge supervising the leak investigation grand jury, William Carpenter, to authorize the release of the additional emails.

She also called on Carpenter to release documents related to the protective order she said he signed to prevent the release of those emails and to give her immunity from potential charges of witness tampering that could come with their disclosure.

Carpenter's secretary said he hadn't read Kane's statement and wouldn't comment Wednesday.

Risa Vetri Ferman, the Montgomery County prosecutor who brought the charges against Kane, said in a statement: "The District Attorney's Office does not respond to comments made by criminal defendants."

Kane won office in 2012, the first woman and first Democrat to be elected attorney general. She also is the highest-ranking woman in Pennsylvania state government.

The attorney general had portrayed herself as a political target for taking on a corrupt, old-boy law enforcement network and exposing state employees who exchanged pornographic emails.

In her statement Wednesday, she said she was taking a different tack.

"My defense will not be that I am the victim of some old-boys' network. It will be that I broke no laws of the Commonwealth. Period," she said, though she went on at length to repeat some of those same allegations.

A growing number of Democratic officials, including Gov. Tom Wolf, have called on her to step down. Her critics worry the charges have damaged the office's credibility and her legal battle will distract her from the responsibilities of her positon.

Kane, in response, cited 135 child predator arrests, 645 drug arrests and a $2.4 million settlement with an electric supplier that had overcharged customers in the nine months since a grand jury first recommended charges against her.

"If these numbers are a distraction, then maybe more public-service employees need to be distracted," Kane said.

A citizen's complaint filed with the state Supreme Court's Disciplinary Board could set in motion a suspension of Kane's law license that could force her out of office. Kane asked the disciplinary board to halt any action until Carpenter authorizes her to release the emails.

Prosecutors have also accused Kane of instructing some of her staff to monitor employee emails as the grand jury was wrapping up its investigation of her.

Patrick Reese, a former police chief who is Kane's driver and head of her security, pleaded not guilty Tuesday to a contempt charge involving allegations he violated a judge's order by accessing emails in a state computer system to keep tabs on the grand jury investigation.

Expect her to be Biden's V-P running mate! Big Grin

Kathleen Kane held on all charges, including perjury & obstruction of justice

Quote:PHILADELPHIA (AP) —

5:25 p.m. BREAKING UPDATE: Channel 11's Joe Holden reports Kane has been held over on all charges.

This is a breaking news update. Check back often for an updated story.

Accusations that the state's attorney general used her position to smear a civil rights leader's reputation are moot because he had already been the subject of negative newspaper articles, her lawyer argued Monday at her preliminary hearing.

Gerald Shargel, who once represented New York City mobsters, sparred with a suburban Philadelphia judge as he tried to chip away at official oppression charges against Attorney General Kathleen Kane.

(SAY no more!!! Rolleyes )

Kane, a 49-year-old first-term Democrat, is accused of leaking secret grand jury information to the press, lying under oath and ordering aides to illegally snoop through computer files to keep tabs on an investigation into the leak.

District Judge Catherine Rebar is expected to decide whether to send all or some of the charges to trial.

The judge tangled with Shargel as he attempted to use his cross-examination of a top Kane aide as a platform to argue against the oppression charges.

Shargel contended that former Philadelphia NAACP head J. Whyatt Mondesire already lost his reputation when articles dating to 2010 alleged issues with his finances. Shargel said Mondesire couldn't lose his reputation a second time.

Kane is accused of leaking a confidential grand jury memo and transcript related to the Mondesire case to a Philadelphia Daily News reporter to embarrass rival prosecutors involved in the case.

"I'm not here as a potted plant. I'm here to represent my client," Shargel said, as Rebar attempted to rein him in with a reminder of the looser rules of evidence and lower burden of proof at a preliminary hearing.

(THAT remains to be seen! Tongue )

Mondesire wasn't charged with a crime.

Detective Paul Bradbury, who investigated Kane, said the leak caused Mondesire "great personal distress and distress to his family" and forced him to close his charity when donations dried up after the newspaper story.

Montgomery County prosecutors charged Kane this month following the recommendations of a grand jury.

A perjury conviction alone could land Kane in prison for up to seven years.

Special Agent David Peifer, who's in charge of special investigations for Kane's office, testified he provided her with a copy of a transcript related to Mondesire months before it appeared in a Daily News article last year.

Peifer also testified that he had a copy of a memo related to a confidential case emailed to her last summer.

Kane told a grand jury last November she had never seen the memo, Bradbury testified.

Kane didn't comment to reporters Monday as she followed an entourage of law enforcement agents and her twin sister into the courtroom.

She hasn't entered a plea but has said publicly that she committed no crimes in a long feud with rival prosecutors, including top deputies who had left her office.

According to prosecutors, Kane increasingly focused on lawyers who challenged her decisions, including career prosecutor Frank Fina, who revived a statehouse corruption case after moving to the Philadelphia district attorney's office.

"This is war," Kane wrote in a March 2014 email, according to the criminal affidavit, which describes an almost Shakespearean level of intrigue, jealousy and vengeance inside the normally staid attorney general's office.

Kane has dismissed the probe as unfair backlash over her challenge to what she calls the old-boys' network in state government.

She is the first woman elected attorney general in Pennsylvania, and she has called out former lawyers in the office and even a Supreme Court justice in a probe of pornography circulated on state email. The justice stepped down over the images.

Kane bound into office as a rising political star in 2013 before internal feuds burst into view in the media.

After Kane was charged, Democratic Gov. Tom Wolf and other fellow Democrats urged her to step down. She has vowed to remain in office.

So a KLIN - TON I desk squatter, using a MOB lawyer... Here's my "shocked" face... Dodgy

Court suspends Pennsylvania attorney general's law license

Quote:HARRISBURG, Pa. —

Pennsylvania's highest court on Monday ordered the temporary suspension of state Attorney General Kathleen Kane's law license, a step that could trigger efforts to remove her from office as she fights criminal charges.

The unanimous order by the state Supreme Court's five justices also could prompt a legal challenge from the first-term Democrat. In the meantime, it leaves the state's top law enforcement official in charge of a 750-employee office and a $93 million budget but without the ability to act as a lawyer.

The state constitution requires the attorney general to be a licensed lawyer, but the court said in the order that its action should not be construed as removing her from office, raising questions about her ability to do the full range of duties associated with the office.

In a statement, Kane said she was disappointed in the court's action, but grateful that it recognized her rights as an elected official.

Then, Kane took a shot at a pornographic email scandal uncovered by her office that involved numerous current and former officials there and claimed the job last year of a state Supreme Court justice.

Kane said she would continue the work of her office, including rooting out "the culture of misogyny and racially/religiously offensive behavior that has permeated law enforcement and members of the judiciary in this Commonwealth for years."

The office's spokesman said Kane will continue performing all duties not prohibited by the court's order, including setting priorities and making administrative decisions.

The first deputy attorney general, Bruce Beemer, a career prosecutor, will likely assume duties she can no longer perform, the spokesman said.

The order comes barely a month after Montgomery County authorities arrested Kane on charges she leaked secret investigative information to a newspaper reporter and then lied about it under oath. She was charged with perjury, obstruction and other counts.

Kane has maintained she did nothing wrong. Gov. Tom Wolf, a fellow Democrat, called on Kane to resign after she was charged Aug. 6...

Pennsylvania attorney general to discuss future of office

Quote:She has discussed the possibility of running for a second term. But she's facing stiff resistance from within her party in the primary and she isn't backed by any identifiable campaign organization.

News today was she won't run for another term. She'll probably run for a federal office.
